Whisperer Terms of Service

These terms govern Whisperer, an Apple Watch app with an optional iPhone companion developed by Alex Spaulding. By using the app, you agree to these terms and the Privacy Policy.
Free app features and your OpenAI account
Whisperer’s local features do not require a Whisperer subscription. AI features use an OpenAI API key that you own or are authorized to use. OpenAI bills API usage directly to your account under its terms and pricing. A ChatGPT subscription does not include API usage. Whisperer does not sell API credits, set an account-wide spending limit, or guarantee a provider’s price.
You are responsible for securing your API key, choosing appropriate provider permissions, and monitoring usage. Removing a key from Whisperer does not revoke it with OpenAI. Account limits, model access, service availability, and provider billing remain controlled by OpenAI.
Device and network requirements
Standalone Apple Watch AI requests require an internet connection and a saved key with consent. Rich rendering and companion archives depend on an available paired iPhone. Apple controls background execution and transfer timing. Native math and readable source fallbacks are available when companion rendering cannot finish. Keep separate backups of information you need; device loss, deletion, and interrupted transfers can affect local data.
Acceptable use
Comply with applicable law and OpenAI’s service terms and usage policies. Submit only content you have authority to share. Do not use another person’s credentials, violate privacy or intellectual-property rights, or use the app to produce unlawful or abusive content.
AI output
AI output may be inaccurate, incomplete, or offensive. Verify answers before relying on them, particularly for health, legal, financial, and safety decisions. Whisperer is not affiliated with or endorsed by OpenAI or Apple.
App license
For App Store distribution, Apple’s standard licensed application terms apply unless a separate license is presented. The app’s source code has its own source-available license; these terms do not grant redistribution or commercial rights to that source.
Availability and liability
To the extent permitted by law, the app is provided as available, without a guarantee of uninterrupted service, accurate AI output, or recovery of local data. We are not responsible for third-party provider outages or charges you authorize. Nothing in these terms limits rights or liabilities that cannot legally be excluded.
